Citation
Regulation (EU) 2024/1689, Article 50(2): Providers of AI systems, including general-purpose AI systems, generating synthetic audio, image, video or text content, shall ensure that the outputs of the AI system are marked in a machine-readable format and detectable as artificially generated or manipulated. Providers shall ensure their technical solutions are effective, interoperable, robust and reliable as far as this is technically feasible, taking into account the specificities and limitations of various types of content, the costs of implementation and the generally acknowledged state of the art, as may be reflected in relevant technical standards. This obligation shall not apply to the extent the AI systems perform an assistive function for standard editing or do not substantially alter the input data provided by the deployer or the semantics thereof, or where authorised by law to detect, prevent, investigate or prosecute criminal offences.
Condition
Requires synthetic audio, image, or video content to be watermarked and disclosed as artificially generated or manipulated. Article 50(2) of the EU AI Act. This rule covers references to generating synthetic media without the required watermark/disclosure pipeline.
Layer 1 detects
"generate", "produce", "create", "render", "synthesise" or "synthesize", optionally followed by "synthetic", "AI-generated", "deepfake" or "AI-made", then "image", "video", "audio", "voice", "speech", "face", "photo" or "picture" (singular), then "without", "with no", "no", "skip", "skipping", "bypass" or "bypassing" (the last four optionally followed by "the"), then "watermark", "disclosure", "marker", "C2PA" or "provenance"; "image", "video", "audio" or "voice" (singular) followed by "without", "with no" or "no", optionally "AI", then "watermark", "disclosure" or "marker"; "disable", optionally followed by "the", then "watermark", "disclosure", "marker" or "C2PA"; and "strip", optionally followed by "the", then "watermark", "C2PA" or "provenance". Case is ignored, the words must follow each other with no other word between them unless stated, and a phrase can start inside a longer word. It matches wording, not meaning: it misses the practice told in other words or with plural nouns, and it does not read the assistive-editing exception: "Our photo editor upscales the user's own image without watermark because it only performs standard editing." fires. Whether a text does the practice is judged in Layer 2.
