Citation
Regulation (EU) 2024/1689, Article 50(4), first subparagraph: Deployers of an AI system that generates or manipulates image, audio or video content constituting a deep fake, shall disclose that the content has been artificially generated or manipulated. This obligation shall not apply where the use is authorised by law to detect, prevent, investigate or prosecute criminal offence. Where the content forms part of an evidently artistic, creative, satirical, fictional or analogous work or programme, the transparency obligations set out in this paragraph are limited to disclosure of the existence of such generated or manipulated content in an appropriate manner that does not hamper the display or enjoyment of the work.
Condition
Requires deployers of AI systems generating deepfake image, audio, or video content to disclose that the content has been artificially generated or manipulated. Article 50(4) of the EU AI Act. Narrow exceptions apply for art, satire, and law enforcement.
Layer 1 detects
"deepfake", "face swap", "face synth", "voice clone", "voice synth", "lip sync" or "lip synced" (each also written with a hyphen or as one word), "impersonate" or "impersonation" followed by "video", "audio" or "clip", or "AI-generated video" or "AI-generated clip" of a person, when, within 100 characters after it on the same line, the word "without", "with no", "no", "skip", "skipping", "bypass" or "bypassing" (each optionally followed by "the"), "hide", "hiding" or "hidden" is directly followed by "disclosure", "disclaimer", "label", "marker", "notice", "watermark", or the quoted words "ai-generated" or "deepfake"; "undisclosed" followed by "deepfake", "face swap" or "voice clone"; and "generate", "produce", "create" or "make", optionally followed by "a", then "deepfake of" or "deepfake that". Case is ignored, the words must follow each other with no other word between them unless stated, and every phrase but the negation word can start inside a longer word. It matches wording, not meaning: it misses a deepfake published with none of these words near it, and the "generate a deepfake of" form fires whether or not the content is labelled, including the labelled satire case the description names: "For the satire show, generate a deepfake of the minister singing, labelled as AI-generated in the opening frame." fires. Whether a text does the practice is judged in Layer 2.
