- Citation
- Regulation (EU) 2024/1689, Article 5(1), first subparagraph, point (d): The placing on the market, the putting into service for this specific purpose, or the use of an AI system for making risk assessments of natural persons in order to assess or predict the risk of a natural person committing a criminal offence, based solely on the profiling of a natural person or on assessing their personality traits and characteristics; this prohibition shall not apply to AI systems used to support the human assessment of the involvement of a person in a criminal activity, which is already based on objective and verifiable facts directly linked to a criminal activity.
- Condition
- Prohibits AI systems that make risk assessments of natural persons to predict the probability of committing a criminal offence, based solely on profiling or on assessing their personality traits and characteristics. Article 5(1)(d) of the EU AI Act. The prohibition does not apply to AI systems used to support human assessment based on objective and verifiable facts directly linked to a criminal activity.
- Layer 1 detects
- "predictive policing"; "pre-crime" (or "pre crime", "precrime") followed by predict, assess or detect; predicting, assessing or forecasting the probability, risk or likelihood of crime, a criminal act, an offence or reoffending, with "of" directly after the noun ("predict the risk of reoffending"); a crime or criminal probability or risk followed by predict, score or assess ("criminal risk score"); scoring, assessing, predicting, ranking or rating individual criminal, crime or offender risk, probability or propensity ("rank individual offender risk"); "individual criminal" risk, probability or propensity on its own; offender or recidivism risk or probability followed by the bare word "predict" or "score" and then based on profiling, from profiling or from personality ("offender risk score based on profiling"); profiling-based or personality-based crime, criminal or offence prediction or risk; and "criminal risk from personality". It matches wording, not meaning: it misses the practice told in other words ("Predict the probability of each resident committing a crime from their personality test results."), it does not read the exception for support to a human assessment based on objective and verifiable facts, and it fires on text that only names the practice, such as a refusal. Whether a text does the practice is judged in Layer 2.
