Citation
NYC Admin Code §20-871(a): In the city, it shall be unlawful for an employer or an employment agency to use an automated employment decision tool to screen a candidate or employee for an employment decision unless: 1. Such tool has been the subject of a bias audit conducted no more than one year prior to the use of such tool; and 2. A summary of the results of the most recent bias audit of such tool as well as the distribution date of the tool to which such audit applies has been made publicly available on the website of the employer or employment agency prior to the use of such tool.
Condition
Prohibits employers and employment agencies in New York City from using an automated employment decision tool (AEDT) unless: (1) the tool has been subject to a bias audit within one year of use, (2) information about the bias audit is publicly available, and (3) certain notices have been provided to employees or job candidates. NYC Local Law 144 of 2021.
Layer 1 detects
use, using or deploy (and words that begin with them), then AEDT, automated employment decision tool, AI hiring, recruiting or screening tool, or algorithmic hiring, screening or recruiting, then without or lacking, then bias audit or disparate impact audit or analysis; no or without, then bias audit or independent audit, then of or for, then a hiring, employment, recruiting or screening tool, system, algorithm or AI; a hiring, recruiting or screening tool, algorithm or AI audit (or bias audit) not public, posted, disclosed or published; fail, failing, skip or skipping (to) notify, inform or notice a candidate, applicant or employee, singular, about, of or regarding an AEDT, automated, AI or algorithmic tool, system or use; no or without candidate, applicant or employee notice before or prior to an AEDT, automated employment or AI hiring; and NYC or New York City hiring, employment or recruiting AI, algorithm or tool, then without or lacking, then audit, notice or compliance. The words follow each other with nothing in between. It matches wording, not meaning: it misses the practice told in other words ("Use the AI screening tool without bias audit for the Brooklyn warehouse hiring." has the word "the" after "Use"; "Skip notifying candidates about automated tool use in our NYC hiring." uses notifying and candidates), and it fires on text that only names the practice. Whether a tool is used without its audit or notice is judged in Layer 2.
