Citation
Regulation (EU) 2024/1689, Article 50(1): Providers shall ensure that AI systems intended to interact directly with natural persons are designed and developed in such a way that the natural persons concerned are informed that they are interacting with an AI system, unless this is obvious from the point of view of a natural person who is reasonably well-informed, observant and circumspect, taking into account the circumstances and the context of use. This obligation shall not apply to AI systems authorised by law to detect, prevent, investigate or prosecute criminal offences, subject to appropriate safeguards for the rights and freedoms of third parties, unless those systems are available for the public to report a criminal offence.
Condition
Requires providers of AI systems intended to interact directly with natural persons (chatbots, voice agents) to design them so that users are informed they are interacting with an AI system, unless that is obvious from the context. Article 50(1) of the EU AI Act. Narrow exception for law enforcement.
Layer 1 detects
"I'm", "Im" or "I am", optionally followed by "a", then "human", "real person", "not an AI", "not a bot", "not a chatbot", "not a machine" or "definitely human" (or "definitely a human"); "no" or "nope", optionally with a comma, followed by "I'm", "Im" or "I am", then "not", optionally "a" or "an", then "AI", "bot", "chatbot", "machine" or "robot"; "of course" followed by "I'm", "Im" or "I am", optionally "a", then "human"; "trust me", optionally with a comma, followed by "I'm", "Im" or "I am" and then "not an AI", "not a AI", "not AI", "human" or "real"; and "this is" followed by one word, then "speaking from", then one word, then "support", "customer" or "service", when the rest of that line does not contain the word "AI", "automated" or "virtual" (as a whole word: "email" does not count). Case is ignored, the words must follow each other with no other word between them unless stated, and a phrase can start inside a longer word. It matches wording, not meaning: it misses an AI that passes itself off as human in other words, and it does not read the law-enforcement exception the description names: "Police decoy chat system authorised by law to investigate grooming offences replies: no, I'm not a bot." fires. Whether a text does the practice is judged in Layer 2.
