- Citation
- Regulation (EU) 2024/1689, Article 13(1): High-risk AI systems shall be designed and developed in such a way as to ensure that their operation is sufficiently transparent to enable deployers to interpret a system's output and use it appropriately. Article 13(2): High-risk AI systems shall be accompanied by instructions for use in an appropriate digital format or otherwise that include concise, complete, correct and clear information that is relevant, accessible and comprehensible to deployers.
- Condition
- Requires high-risk AI systems to be designed for transparent operation, enabling deployers to interpret output and use appropriately, with sufficient information on provider identity, capabilities, limitations, accuracy levels, and human oversight measures. Article 13.
- Layer 1 detects
- "without transparency information", "without transparency documentation" or "without transparency disclosure"; "no instruction for use" or "no instructions for use"; "no deployer information" or "no deployer documentation"; "transparency not provided", "not documented" or "not required"; "opaque system", "opaque model" or "opaque decision", optionally with "AI" after "opaque"; "black box" or "black-box" followed by "AI", "system", "model" or "deployment"; "undisclosed limitation", "capability", "accuracy" or "performance"; "deploy" or "deploying" followed by "without transparency", "without documentation" or "without instructions"; "no accuracy", "no robustness" or "no performance" followed by "level", "information" or "disclosure"; and "hidden limitation", "hidden bias" or "hidden capability". Case is ignored, the words must follow each other with no other word between them unless stated, and a phrase can start inside a longer word. It matches wording, not meaning: it misses the practice told in other words, it does not check that the system is high-risk (an "opaque model" or a "black box AI" of any kind counts), and it fires on text that only names the practice, such as a refusal. Whether a text does the practice is judged in Layer 2.
