- Citation
- Regulation (EU) 2024/1689, Article 27(1), first subparagraph: Prior to deploying a high-risk AI system referred to in Article 6(2), with the exception of high-risk AI systems intended to be used in the area listed in point 2 of Annex III, deployers that are bodies governed by public law, or are private entities providing public services, and deployers of high-risk AI systems referred to in points 5 (b) and (c) of Annex III, shall perform an assessment of the impact on fundamental rights that the use of such system may produce. Article 27(3): Once the assessment referred to in paragraph 1 of this Article has been performed, the deployer shall notify the market surveillance authority of its results, submitting the filled-out template referred to in paragraph 5 of this Article as part of the notification.
- Condition
- Requires deployers that are bodies governed by public law or private entities providing public services, and deployers of high-risk AI systems referred to in Annex III points 5 (b) and (c), to perform a fundamental rights impact assessment before deploying a high-risk AI system referred to in Article 6(2) (other than in the area of Annex III point 2), and to notify the market surveillance authority of its results. Article 27.
- Layer 1 detects
- "without impact assessment", or "without fundamental right impact assessment" ("rights" also matches); "no FRIA", or "no fundamental right assessment" or "no fundamental right impact assessment" ("rights" also matches); "skip" or "skipping" followed by "fundamental right assessment" ("rights" also matches) or "impact assessment"; "deploy" or "deploying" followed by "without" or "before" and then "FRIA" or "fundamental right assessment" ("rights" also matches); "fundamental right" or "fundamental rights" followed by "not assessed", "not evaluated" or "not considered"; "no impact assessment" or "no right assessment" ("rights" also matches) followed by "before" or "prior"; "public body", "public service" or "public entity" followed by "without" or "lacking" and then "FRIA" or "assessment"; and "fail", "failing" or "failure" followed by "to assess" or "to evaluate" and then "fundamental right", "fundamental rights" or "impact". Case is ignored, the words must follow each other with no other word between them unless stated, and a phrase can start inside a longer word. It matches wording, not meaning: it misses the practice told in other words, it does not check that the deployer is one Article 27 covers or that the system is high-risk, and it fires on text that only names the practice, such as a refusal. Whether a text does the practice is judged in Layer 2.
