Citation
Regulation (EU) 2024/1689, Article 5(1)(e): the placing on the market, the putting into service for this specific purpose, or the use of AI systems that create or expand facial recognition databases through the untargeted scraping of facial images from the internet or CCTV footage.
Condition
Prohibits placing on the market, putting into service, or using AI systems that create or expand facial recognition databases through the untargeted scraping of facial images from the internet or CCTV footage. Article 5(1)(e). Effective 2 February 2025.
Layer 1 detects
scraping, harvesting, crawling, bulk or mass downloading, or mass collecting of facial or face images, photos, pictures, data or recognition data; a facial or face image, photo, picture or recognition database or dataset from, using or via scraping, harvesting, crawling, untargeted collection, a web crawl, the internet or CCTV; untargeted, indiscriminate, bulk or mass collection, gathering or acquisition of facial or face images or data; creating, building, expanding, growing or populating a facial or face recognition database, dataset or model from, via, using or by scraping, the web, the internet, CCTV or untargeted collection, with no word between the verb and "facial"; web, internet or CCTV scraping, crawling or harvesting for, or to build, create or train, facial or face recognition; and a Clearview or PimEyes style, like or approach face database or recognition. It matches wording, not meaning: it misses the practice told in other words ("pulled 2.3M profile pictures and added the face embeddings to our matching index"), and it fires on text that only names the practice, such as a refusal. Whether a text does the practice is judged in Layer 2.
